Atkinson Rose LLP Privacy Notice

Last updated: 26 October 2026

Who we are

Atkinson Rose LLP is a claims management company specialising in employment matters. We are the data controller for the personal information described in this notice, which means we decide how and why it is used.

Atkinson Rose LLP
Company number OC365819
Registered office: 24 Greville Street, London EC1N 8SS

We are authorised and regulated by the Financial Conduct Authority in respect of regulated claims management activities, firm reference number 836433. You can check our entry on the Financial Services Register at register.fca.org.uk.

If you have a question about this notice, want to exercise any of your rights, or wish to complain about how we have handled your information, contact us at info@atkinson-rose.co.uk or write to us at the address above, marking your letter for the attention of Louise Reed.

This notice explains what we do with personal information about clients, prospective clients, the people involved in their matters, and visitors to our website.

What information we collect

If you contact us about an employment matter, whether through the website form, by telephone, email or WhatsApp, we collect your name, contact details and whatever you tell us about your situation.

If you become a client, we also collect and hold everything needed to advise you and run your matter. That typically includes your employment contract and correspondence with your employer, details of your salary, benefits and length of service, the settlement agreement or tribunal documents, identification documents, and records of our advice to you and our communications with you.

Some of this is sensitive. Employment disputes frequently involve information about health and medical conditions, disability, pregnancy and maternity, race or ethnic origin, religion, sexual orientation, gender reassignment, or trade union membership, because these are often the subject of the complaint. Where that information is relevant to your matter we will hold it. The law calls this special category data and treats it with additional protection.

If you are not our client but are involved in a matter we are handling, for example an employer's HR contact, a witness, a manager named in a grievance, or a representative on the other side, we will hold your name, role, contact details and whatever is relevant to the matter. We usually receive this from our client rather than from you.

If you visit our website, we collect information about your visit through cookies and similar technologies, including pages viewed, time spent and how you arrived. The cookies section below explains your choices.

If you enquire about working with us, we hold your application and the information in it for the duration of the recruitment process.

Why we use it, and our legal basis

Data protection law requires us to have a legal basis for everything we do with your information. Ours are set out below.

  • Responding to your enquiry and assessing whether we can help: our legitimate interest in answering people who approach us, and taking steps at your request before entering a contract.

  • Advising you and running your matter: performance of our contract with you.

  • Acting for you in a tribunal claim or negotiation: performance of our contract with you.

  • Holding information about other people involved in your matter: our legitimate interest, and yours, in being able to advise you properly on the facts.

  • Meeting our obligations to the FCA, including complaints handling and record keeping: compliance with a legal obligation.

  • Keeping accounts and recovering fees: compliance with a legal obligation, and our legitimate interest in being paid.

  • Dealing with complaints, claims against us and our insurers: our legitimate interest in defending ourselves, and compliance with a legal obligation.

  • Improving our website and understanding how people find us: your consent, given through the cookie banner.

  • Sending you information about our services, where you have asked for it: your consent.

Where we rely on legitimate interests, we have considered whether our interest is outweighed by your rights. You can object to that processing, and we explain how below.

Sensitive information

For the special category information described above, we rely on the condition in Article 9(2)(f) of the UK GDPR: the processing is necessary for the establishment, exercise or defence of legal claims. This is the standard basis on which solicitors and claims management firms hold information of this kind, and it reflects the fact that in an employment dispute the sensitive information usually is the claim.

Where we hold information about criminal convictions or allegations, which can arise in dismissal cases, we rely on the same legal claims condition in Schedule 1 of the Data Protection Act 2018.

Who we share it with

We do not sell your information and we do not share it for anyone else's marketing.

We share it where your matter requires it: with your employer or their advisers when we negotiate on your behalf, with the Employment Tribunal and ACAS, with barristers we instruct for you, and with any expert you agree we should involve.

We also use suppliers who handle information on our behalf and only on our instructions. Each is bound by a written contract that requires them to keep it secure and prevents them using it for their own purposes.

  • Google (Google Workspace): our email, documents, calendars and file storage.

  • ClickUp: our case management records.

  • Anthropic (Claude): our AI assistant, used for research, drafting and document review, as described below.

  • Zapier: moves information automatically between our other systems.

  • BoldSign (Syncfusion): sends documents out for electronic signature.

  • Wati: our WhatsApp business messaging.

  • Wix: hosts our website and the forms on it.

We may also share information with our accountants, auditors and insurers, with our regulators where they require it, and with the police or other authorities where the law obliges us.

If the firm is ever sold or merged, client information would transfer with it, and we would tell you before that happened.

Sending information outside the UK

Several of the suppliers listed above are based outside the United Kingdom, mainly in the United States, and your information may be stored or processed there.

Where that happens we rely on the safeguards the law requires: either the UK government has decided the country offers adequate protection, or our contract with the supplier includes the International Data Transfer Agreement or the UK Addendum to the European Standard Contractual Clauses. These are standard legal terms approved for this purpose, and they oblige the supplier to protect your information to UK standards wherever it is held.

You can ask us for details of the safeguards that apply to any particular supplier.

How long we keep it

We keep information only as long as we need it.

  • Enquiries that do not become matters: 1 year.

  • Client files after a matter closes: 6 years, reflecting the time limit for bringing a claim against us.

  • Accounting records: 6 years, as tax law requires.

  • Complaints records: 6 years from the date the complaint is resolved.

  • Website analytics: 26 months.

  • Recruitment records for unsuccessful applicants: 6 months.

At the end of those periods we delete or securely destroy the information. Where we need to keep something longer, for example because a complaint or claim is outstanding, we keep only what is necessary for that purpose.

Our use of AI tools

We use artificial intelligence tools to help us with research, drafting documents and reviewing papers. Being open about this matters to us, so here is what it does and does not mean.

Everything produced with these tools is checked by a qualified member of our team, who remains responsible for the advice you receive. The tools do not make decisions about your matter and they do not replace our judgement.

We use them under commercial contracts that prohibit the supplier from using your information to train AI systems. Your information is not added to a public AI service and is not used to answer anyone else's questions.

If you would prefer us not to use these tools on your matter, tell us and we will note it on your file. It will not affect the service you receive.

Your rights

You have the following rights over your information. They are free to exercise and we will respond within one month.

  • Access. You can ask for a copy of the information we hold about you.

  • Correction. You can ask us to correct anything inaccurate or complete anything missing.

  • Erasure. You can ask us to delete your information. We cannot always agree, because we are required to keep client files for a period and to retain records for the FCA, but we will explain our reasons if we refuse.

  • Restriction. You can ask us to stop using your information while a question about it is resolved.

  • Portability. Where we hold information you gave us and we use it to perform our contract with you, you can ask for it in a portable electronic format, or ask us to send it to someone else.

  • Objection. You can object to processing we carry out on the basis of legitimate interests. You can object to direct marketing at any time and we will stop.

  • Withdrawing consent. Where we rely on your consent, you can withdraw it at any time. That does not affect anything we did before you withdrew it.

We do not make decisions about you by automated means alone.

To exercise any of these rights, contact us at info@atkinson-rose.co.uk. We may ask you to confirm your identity first.

Complaining

If you are unhappy with how we have handled your information, please tell us first so we can put it right. Our complaints procedure is on our website.

You also have the right to complain to the Information Commissioner's Office, the UK regulator for data protection, at ico.org.uk/make-a-complaint or on 0303 123 1113. You can complain to the ICO without coming to us first.

If your complaint is about our claims management service rather than your information, you may be able to take it to the Financial Ombudsman Service. Our complaints procedure explains how.

Cookies

Cookies are small files a website puts on your device. Some are necessary for the site to work, such as remembering what you have typed into a form. Others help us understand how people use the site, or let us measure whether our advertising is working.

We only use the non-necessary ones if you agree. When you first visit, a banner asks for your choice, and you can change it at any time through the cookie settings link in the footer. Declining does not stop you using the site.

We use Google Analytics to understand how people find and use our website, and Google Ads to measure our advertising. Both set cookies only once you have agreed.

You can also control cookies through your browser settings, though blocking all cookies may stop parts of the site working.

Changes to this notice

We review this notice at least once a year and whenever we change how we handle information. The date at the top shows when it was last updated.

If we make a significant change, we will say so on this page, and we will tell current clients directly where the change affects them.
